1. Acceptance of Terms

By accessing or using ShulSearch ("the Site", "we", "us", or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site. We reserve the right to modify these terms at any time. Continued use of the Site after changes constitutes acceptance of the revised terms.

2. Description of Service

ShulSearch is an independent real estate search platform that helps users find properties near places of worship, schools, and Jewish community resources in South Florida. ShulSearch is not a licensed real estate brokerage and does not provide real estate, legal, financial, or tax advice. All content is for general informational purposes only.

3. No Agency Relationship

Use of this Site does not create a brokerage, agency, fiduciary, or client relationship between you and ShulSearch or any of its operators, employees, or affiliated parties. ShulSearch is not a licensed real estate broker, agent, or salesperson. We strongly encourage you to consult a licensed agent or broker before making any real estate decision.

4. IDX / MLS Data Disclaimer

Listing information displayed on ShulSearch is sourced from participating Multiple Listing Services (MLS) and/or third-party providers. All listing data is deemed reliable but not guaranteed and is subject to errors, omissions, price changes, prior sale or lease, or withdrawal without notice. Not all properties available for sale or lease may be displayed.

Information should be independently verified before relying on it.

5. Broker Attribution

Each property listing is attributed to the listing broker as required by MLS rules. ShulSearch does not claim ownership of listing data and displays such data in accordance with MLS licensing agreements. The listing broker's offer of compensation is made only to participants of the MLS where the listing is filed.

6. Fair Housing Compliance

ShulSearch fully supports the Fair Housing Act and all applicable federal, state, and local housing laws. ShulSearch does not discriminate and will not facilitate discrimination based on race, color, religion, sex, national origin, disability, familial status, or any other protected class.

Any proximity-based search tools — including distance to places of worship, schools, or community locations — are user-initiated and provided for informational purposes only. Users are solely responsible for the choices they make using these tools.

7. Place of Worship & Location Data

Information about places of worship — including synagogues, churches, mosques, and temples — their locations, distances, denominations, and related details are provided for general informational purposes only. ShulSearch does not guarantee the accuracy of location data, hours of service, denominational affiliations, or any other information. Distances, travel times, and proximity calculations are approximate. Users should independently verify all information before relying on it.

8. School Data

School information displayed on ShulSearch is sourced from the National Center for Education Statistics (NCES) and other public data sources. ShulSearch does not guarantee the accuracy, completeness, or currency of school information, including names, addresses, grade ranges, or school types. Users should independently verify all school information directly with the relevant institution.

9. Intellectual Property

All original content on ShulSearch — including but not limited to its name, logo, brand identity, design, user interface, software, source code, algorithms, proximity scoring methodology, curated databases, and original text — is the exclusive property of ShulSearch and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, copy, distribute, modify, publicly display, sell, license, reverse engineer, decompile, disassemble, or create derivative works based on any part of the Site or its content without our prior written consent. Unauthorized use may subject you to civil and criminal liability.

10. Prohibited Uses

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Scrape, crawl, harvest, or systematically download any data from the Site
• Use automated tools, bots, or scripts to access or extract Site content
• Copy, clone, or build a competing product that substantially replicates ShulSearch's features, design, or data
• Access or use ShulSearch data to train, fine-tune, or improve any artificial intelligence or machine learning model
• Attempt to gain unauthorized access to any part of the Site or its infrastructure
• Interfere with, disrupt, or overburden the Site's servers or networks
• Transmit spam, malware, viruses, or other harmful code
• Misrepresent your identity, affiliation, or intentions
• Use the Site in any way that violates applicable Fair Housing laws
• Resell, sublicense, or commercially exploit any part of the Site without written permission

11. User Accounts

You may create an account to save listings and access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to provide accurate information and notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

12. User-Submitted Content

If you submit any content to ShulSearch (such as contact forms, messages, or inquiries), you grant ShulSearch a non-exclusive, royalty-free license to use that content to operate and improve the Service. You represent that you have the right to submit such content and that it does not violate any third-party rights.

13. Third-Party Links & Services

The Site may contain links to or integrations with third-party websites, services, or professionals. ShulSearch does not control, endorse, or assume responsibility for any third-party content, products, or services. Use of third-party services is at your own risk and subject to their respective terms and policies.

14. DMCA / Copyright Infringement

If you believe any content on ShulSearch infringes your copyright, please send a written notice to info@shulsearch.com including: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on the Site; (c) your contact information; (d) a statement of good faith belief that the use is unauthorized; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

15. Disclaimer of Warranties

The Site and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. ShulSearch does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

16. Limitation of Liability

To the fullest extent permitted by law, ShulSearch, its operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of — or inability to use — this Site, including but not limited to reliance on listing data, place-of-worship information, school data, or proximity calculations. ShulSearch's total liability to you for any claim shall not exceed $100.

17. Indemnification

You agree to indemnify, defend, and hold harmless ShulSearch and its operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third-party rights.

18. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall first be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Miami-Dade County, Florida.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class, consolidated, or representative action.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

20. Termination

ShulSearch reserves the right to suspend or terminate your access to the Site at any time, with or without cause or notice, including for violation of these Terms. Upon termination, all licenses granted to you under these Terms will immediately cease. Sections 9, 10, 15, 16, 17, 18, and 19 shall survive any termination.
